Appeal Pending on Parts Pricing Lawsuit


Oral arguments have been scheduled for December 1 in the appeal of a lawsuit filed by Felder’s Collision Parts against General Motors. According to John Yoswick of the CRASH Network, “the Louisiana-based non-OEM parts supplier sued the automaker, arguing that GM’s ‘Bump the Competition’ parts price-matching program provides no benefit to the consumer, but ‘serves the sole purpose of eliminating competition.’” According to the suit, a dealer (also named in the suit) could sell GM collision parts at predatory prices because GM would provide a “kickback” that allowed the dealer to partially recoup its losses. A U.S. appeals court dismissed the suit earlier this year, but Felder’s is appealing that decision.
