According to John Yoswick at the CRASH Network, a Louisiana aftermarket parts distributor will continue its legal challenge of General Motor’s “Bump the Competition” price-matching program. The suit brought by Felder’s Collision Parts, which held that the GM program was “predatory and anti-competitive,” was dismissed by a federal appeals court in January. Felder’s has petitioned the Supreme Court to consider whether the lower courts’ decision to include rebates to dealers from GM should have been allowed, or if the courts should have focused only on point-of-sale pricing when determining if the GM program was predatory.
