ABPA Addresses International Trade Commission (ITC) on Behalf of Membership


On February 23, 2023, the Automotive Body Parts Association (ABPA) submitted a pair of letters to ITC Secretary to the Commission (Lisa Barton) in response to two exclusion orders issued against our members, LKQ Corp and TYC – Genera Corp. Both cases are related to design patents on headlamps for Kia and Hyundai vehicles (Investigation Numbers 337-TA-1291 and 337-TA-1292).

In our submissions, we focused on two main points; the first was the implications of the exclusion orders for both consumers and the supply chain. Second, we provided our legal design patent opinions on the rulings which were distinctive for each of the two submissions.

The ABPA continues to support our membership regarding design patent abuse by the car companies and we continue to research the issue. Copies of the two ABPA submissions can be found at the links below.
